These Terms of Service (“Terms”) govern your access to and use of the website, quotes, payments, and services provided by Evercrest Construction Group LLC (“Evercrest,” “we,” “us,” or “our”). By accessing our website or using our Services, you agree to these Terms. If you do not agree, please do not use the Services.
Evercrest provides construction, renovation, remodeling, and general contracting management services, and coordinates licensed trades where required by law. Information on our website is general in nature and does not constitute a binding offer. Any work we perform for you is governed by a separate written contract, proposal, or estimate that you sign (the “Project Agreement”). If anything in these Terms conflicts with a signed Project Agreement, the Project Agreement controls for that project.
Quotes and estimates are based on the information available at the time and are not final or binding until reflected in a signed Project Agreement. Pricing may change due to site conditions, scope changes, material costs, permitting, or other factors. Changes to an agreed scope are handled through written change orders.
Payments are processed securely through our third-party payment processor, Stripe, and are also subject to Stripe’s terms. Deposits, progress payments, and final balances are due as stated in your Project Agreement or invoice. Unless stated otherwise in your Project Agreement, payments are non-refundable once the corresponding work or materials have been ordered or performed; any refunds that do apply are issued to the original payment method. Late or unpaid amounts may pause work and may be subject to the remedies described in your Project Agreement and allowed by law.
You agree to provide accurate information, to have the authority to authorize work on the relevant property, to provide reasonable and timely access to the work site, and to review and respond to proposals, change orders, and invoices in a timely manner. You are responsible for obtaining any approvals required from property owners, associations, or co-owners.
Work requiring a license is performed by appropriately licensed professionals where required by law. Any workmanship warranty is as stated in your Project Agreement. Except as expressly provided there or required by applicable law, the Services and our website are provided “as is,” and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Manufacturer warranties for materials and products are provided by their manufacturers.
To the fullest extent permitted by law, Evercrest will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to your use of our website. Liability relating to a specific project is governed by the limitations and remedies set out in your Project Agreement. Nothing in these Terms limits any liability that cannot be limited under applicable law.
The Evercrest name, logo, website content, text, graphics, and design are owned by Evercrest Construction Group LLC and are protected by applicable laws. You may not copy, reproduce, or use them without our prior written permission.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to any different terms in a signed Project Agreement, you agree that the exclusive venue for any dispute arising out of these Terms or your use of our website shall be the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. When we do, we will revise the effective date above and post the updated Terms on this page. Your continued use of the Services after changes take effect means you accept the updated Terms.
